Custom Mill Valley Concrete & Masonry is a masonry contractor serving residential and commercial clients in Mill Valley, CA and surrounding communities. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, driveway pavers, walkway construction, and outdoor kitchen masonry.
We reserve the right to decline any project at our discretion. All services are subject to the availability of our crew and materials.
Written estimates are provided free of charge and are based on the information available at the time of the site visit. An estimate is not a final contract. Final pricing is confirmed in a written agreement before any work begins.
Estimates are valid for 30 days from the date issued. If site conditions differ materially from what was assessed, or if you request changes to the scope of work after an estimate is issued, pricing may be revised. We will notify you of any changes before proceeding.
We do not guarantee that final project costs will match estimates in cases where unforeseen conditions are discovered during work - such as hidden damage, soil conditions, or code-required changes. We will communicate any such discoveries promptly and obtain your approval before continuing.
Project start dates are scheduled based on crew availability and material lead times. We will provide an estimated start date when your agreement is signed. Start dates may shift due to weather, prior project delays, or permit timing. We will notify you as soon as possible of any scheduling changes.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice may result in a fee to cover crew scheduling costs, unless the cancellation is due to circumstances outside your control.
We reserve the right to suspend or terminate work if site conditions become unsafe, if payment obligations are not met, or if access to the property is not provided as agreed.
Payment terms are stated in the written project agreement. For most projects, a deposit is collected before work begins, with the remaining balance due upon completion. Deposit amounts comply with California law, which limits upfront deposits for home improvement contracts.
Final payment is due at the completion of the project and before the crew leaves the site. Accepted payment methods will be specified in your agreement.
Unpaid balances past 30 days from the due date may be subject to collection proceedings. We reserve the right to place a mechanics lien on the property for unpaid work in accordance with California law.
For work that requires a building permit, we will handle the permit application process and include any permit fees in the project estimate. You are responsible for providing reasonable access to the property for permit-required inspections. We are not responsible for delays caused by the permitting authority. If a project is found to require a permit that was not anticipated at the time of the estimate, we will notify you and obtain your approval before proceeding.
We stand behind our work. Specific warranty terms - including duration and coverage - are stated in your written project agreement. At a minimum, we warrant that work will be free from defects in workmanship for the period specified in your agreement.
Warranties do not cover damage caused by events outside our control, including but not limited to: seismic activity, extreme weather events, soil movement beyond normal seasonal variation, acts of third parties, or failure of the client to maintain the work in accordance with our recommendations.
Material warranties, if any, are governed by the manufacturer of the material used and are separate from our workmanship warranty.
Except as expressly stated in your written project agreement, all services and information on our website are provided "as is" and without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Custom Mill Valley Concrete & Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from our services shall not exceed the amount you paid us for the specific work giving rise to the claim.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation or arbitration. Any legal proceedings shall be conducted in the state and county courts with jurisdiction over Mill Valley, CA.
These terms and conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these terms shall be brought exclusively in the courts of the State of California.
